I don't see though how it now will severely limit a chief executive's powers to make recess appointments. Doesn't that privilege still stand when followed accordingly?
This appeals court redefined what it means for Congress to be 'in recess.' Apparently now it only refers to those official breaks between sessions. What's sad is that if the Republicans hadn't blocked every single one of Obama's appointments from an up or down vote, this wouldn't have been necessary in the first place. If you're against one of the POTUS's nominees to head up a federal agency, just vote NO. Don't block a vote entirely. This scorched earth policy being used by the GOP is hurting BOTH sides, not just the President whose administration they want to wreck.
