    Average age of bearing a child went up by a year or two. This isn't much. Instead of 27 or 28. It is 29 or 30. so not exactly a long wait.

    These aren't women in their 40's.

    I find it interesting reading the various sides of the fence on this topic, especially considering my daughters were kidnapped to another state after i filled full custody paperwork. Being a BM in the courts just wanting to be in the lives of your daughters from a WW has been an amazing coaster ride.

    People fail to think about the fact there are amazing dads out there but the sheer number of bad dads tip the scale and the good dads are automatically placed in the other bucket.

    When a dad or mother use the court system with the intention of actually being in the kids lives and not to get back at the other parent the out come and the road is EASY!

    It's going to rain rep points from me on this thread. ha!

    Legally you can't do that. I assume you notified the court the kids were taken out of state without your permission??

    Two years ago I filled for full custody or my girls. They were living with me. I allowed their mom to have them for a few days and on the day of filling she came to pick them up. Three days later I get an email saying they are on the other side of the country.

    I have been battling the California Courts for two years now completely in the right and abiding by court orders however to this day they are still not back in Cali.

    I've been to court numerous times and hopefully this month things came come to head after a hearing...

    The belief is that judges automatically think dads are dead beat until they prove themselves which allowed the mother to keep custody of the kids. Usually the mother files first and has an easier battle which is why I filled first to ensure proper custody of the children are in place.

    My initial mistake was not knowing how the proof of service should be done... since I didn't serve her the papers properly and had an unreliable neighbor attempt to serve her the papers who would not go on record saying she attempted to serve... i couldn't have an amber alert issued(the police wouldn't take action). Since then I've had the Sherriff's and a process server(an ex-cop) serve paper work and making headway.

    By law a parent can take the kids to another state unless a court order is in place or a pending court date after proper proof of service by person.

    I am so sorry you are going through this. I really wish you the best because in NY where Im from its the same crap. The mother still holds so many rights and us good fathers are suffering for it.
    Man... I have witnessed even a crack head whore mother get the kids from a coworker who damn near had the Cosby family thing going on with their kids. I thought that was just wrong.

    You are not at the finish line yet. So she may have them now but not by order of the court. Keep doing things by the letter of the law. Don't answer her bad with bad. Keep records with dates and info. And most things can be done on your own....such as the filing...... you made a mistake and now you learn.. Read everything and follow the laws. Good luck.

    Yah. :D Dont be sorry, be happy like I am. Things could be a lot worst and at least when I do see my girls it's nothing but lots of love and fun. They know I'll always come back and fight to be in their lives. Plus since I'm forced into being a Vacation Dad I'm making the best of it!

    Don't be! I'm built tougher than a ford there have been many very positive things since things went down and that's what i focus on.

    It will! I'm not worried about it.
